Privacy Policy

UserExpLab ("we", "us") is the data controller for personal information collected through this website and our design engagements. We process personal data lawfully, fairly, and transparently, in accordance with the General Data Protection Regulation (GDPR).

What we collect

When you contact us or commission work, we may collect your name, email address, phone number, company name, project details, and billing information. We also collect limited technical data such as IP address, browser type, and pages visited, via essential cookies and privacy-respecting analytics.

Why we process it

  • · To respond to inquiries and prepare proposals (Art. 6(1)(b) GDPR — pre-contractual steps)
  • · To deliver contracted design services and manage invoices (Art. 6(1)(b))
  • · To improve our website and services through aggregated analytics (Art. 6(1)(f) — legitimate interest)
  • · To comply with Spanish and EU tax and accounting obligations (Art. 6(1)(c))

Retention

Contact inquiries are kept for up to 24 months. Client project records and invoices are retained for the legally required 6 years under Spanish commercial law. You may request earlier deletion where no legal retention duty applies.

Your rights

Under the GDPR you have the right to access, rectify, erase, restrict, and port your personal data, as well as to object to processing based on legitimate interest. To exercise any right, write to [email protected]. You may also lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es.

Sub-processors & transfers

We rely on EU-hosted infrastructure providers for email, file storage, and invoicing. We do not sell personal data. Where any processor operates outside the EEA, we ensure appropriate safeguards such as Standard Contractual Clauses are in place.

Terms of Service

These terms govern design and consulting engagements between UserExpLab and its clients. By commissioning services or paying an invoice, you agree to the following conditions.

Scope & statements of work

Every engagement is defined in a written statement of work (SOW) specifying deliverables, timeline, price, and revision rounds. Work outside the agreed SOW is quoted separately before it begins. Published prices on our website are indicative starting points and are confirmed in the SOW.

Payments

Invoices are payable within 14 days of issue unless the SOW states otherwise. Fixed-price projects require a 50% deposit to reserve a studio slot, with the balance due on final handoff. Late payments may accrue statutory interest under Spanish law.

Intellectual property

Upon full payment, UserExpLab assigns all worldwide rights in the client-specific deliverables — design files, prototypes, documentation, and specifications — to the client. We retain the right to reference non-confidential work in our portfolio unless a written NDA states otherwise.

Client responsibilities

Clients provide timely feedback, access to necessary materials, and a single point of contact. Delays in feedback extend delivery dates by an equivalent period. We are not liable for decisions made by your engineering team on implementations that diverge from our delivered specifications.

Liability

To the maximum extent permitted by law, UserExpLab's total liability for any claim arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability for fraud or intentional misconduct.

Governing law

These terms are governed by the laws of Spain. Any dispute shall be submitted to the competent courts of Valencia, without prejudice to mandatory consumer protections that may apply.

Cookie Policy

This site uses a deliberately small number of cookies and browser storage items. We avoid advertising trackers and third-party ad networks entirely.

Essential storage

When you dismiss our cookie notice, we store a single flag in your browser's localStorage named cookie_accepted. This purely functional item prevents the banner from reappearing on every visit. It never leaves your device and is not readable by us.

Third-party embeds

Our contact page embeds a Google Map for our studio address. Loading that map may cause Google to set cookies under Google's own privacy policy. You can avoid this by not interacting with the map, or by reviewing Google's policies directly.

Managing cookies

Most browsers let you block or delete cookies entirely via their settings. Because our only first-party storage is the consent flag, blocking cookies will simply mean the consent banner may reappear on future visits.

Panel 04 Deposits & cancellations

Refund Policy

We want every engagement to feel fair. Because our work is bespoke and time-based, refunds follow a clear, honest structure rather than a one-size-fits-all rule.

Before work begins

If you cancel an engagement before any design work has started, your deposit is refunded in full, less any payment-processor fees already incurred.

After work has begun

Once a studio slot is reserved and work is underway, the deposit becomes non-refundable, as it covers capacity we have set aside exclusively for you. If you cancel mid-project, you are invoiced for the percentage of work completed at the pro-rata SOW rate, and all finished deliverables to that point are transferred to you.

If we cannot deliver

In the rare event that UserExpLab cancels an engagement for reasons within our control, any payments made for undelivered work are refunded in full within 14 business days.

Revision limits

Two structured revision rounds are included in every fixed-price course. Additional rounds are offered at our published hourly rate and quoted in advance — never surprise-invoiced.
